Rental Waiver Agreement
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS & INDEMNITY AGREEMENT
1. Assumption of Risks
I acknowledge that renting and riding a bicycle from Joe's Garage (the "Provider"), located at 335 8 St SW, Calgary, Alberta, involves inherent risks, dangers, and hazards that may result in serious personal injury, permanent disability, or death. These risks include but are not limited to: falls, collisions with vehicles, pedestrians, or stationary objects; mechanical failure of the bicycle; unpredictable road, trail, or weather conditions; and my own physical condition and ability. I freely and voluntarily assume all such risks, both known and unknown.
2. Release of Liability
In consideration of being permitted to rent and use the bicycle, I (acting for myself, my heirs, executors, administrators, and assigns) hereby release, waive, and forever discharge the Provider, its owners, employees, agents, and representatives from any and all claims, demands, actions, or causes of action for personal injury, property damage, or wrongful death arising from my use of the rental bicycle, to the fullest extent permitted by the laws of the Province of Alberta.
3. Waiver of Claims
I waive any and all claims I may have against the Provider arising from my participation in this bicycle rental, including claims arising from the negligence of the Provider, its employees, or agents, except where such claims arise from the gross negligence or wilful misconduct of the Provider, as those terms are understood under Alberta law.
4. Indemnity
I agree to indemnify and hold harmless the Provider from any and all claims, actions, costs, expenses, and demands (including legal fees on a solicitor-client basis) arising from my use of the rental bicycle or my breach of this agreement, whether brought by me or any third party.
5. Equipment Responsibility
I accept full responsibility for the rental bicycle from the time of pickup to the time of return. I agree to inspect the bicycle before use, report any defects immediately, and return it in the same condition as received, subject to normal wear and tear. I agree to pay for repair or replacement costs for any damage, loss, or theft of the bicycle during the rental period.
6. Safety & Helmet Use
I understand that under the Traffic Safety Act (Alberta), riders under the age of 18 are required by law to wear a properly fitted and fastened bicycle helmet. I agree to comply with all applicable laws and municipal bylaws of the City of Calgary while operating the rental bicycle, including but not limited to the Traffic Safety Act (RSA 2000, c T-6) and the City of Calgary Traffic Bylaw 26M96.
7. Age & Fitness
I confirm that I am at least 18 years of age (or have the written consent of a parent or legal guardian), that I am physically capable of safely operating a bicycle, and that I am not under the influence of alcohol, drugs, or any substance that may impair my ability to ride safely.
8. Electronic Signature
I agree that my electronic signature below shall have the same legal force and effect as a handwritten signature, in accordance with the Electronic Transactions Act (SA 2001, c E-5.5) of the Province of Alberta.
9. Governing Law & Severability
This agreement is governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. If any provision of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect. The courts of the Province of Alberta shall have exclusive jurisdiction over any disputes arising under this agreement.
